Terms and Conditions

These terms govern your use of services provided by Northcity Solutions, LLC. By engaging Northcity for work, or by using a service described here, you agree to them.

Services

Northcity Solutions, LLC builds and maintains websites and web applications, migrates sites and data between platforms, and provides managed web hosting and email deliverability work. Engagements are scoped in writing before work begins.

Hosting

• Hosting is billed monthly. Rates are agreed in advance and do not change without notice to you.
• Backups are taken nightly and restores are tested. No backup regime is a guarantee against all loss, so keep your own copy of anything you cannot afford to lose.
• Uptime is monitored continuously. Northcity does not offer a contractual uptime guarantee or service credits.
• You may request a full export of your site, database, and mail at any time, for any reason, and take it elsewhere.
• Northcity may suspend a site that is compromised, sending unsolicited mail, or placing the shared platform at risk, and will tell you why at the time.

Your content and your access

You own your content, your domain names, and your data. Where you hold your own credentials or server keys, you are responsible for keeping them secure. Where Northcity holds them on your behalf, they are used only to do the work you have asked for.

Payment terms

• Project work is invoiced as agreed in the engagement. Hosting and retainers are invoiced monthly.
• Invoices are issued through Wave and are payable by ACH.
• Refunds are handled case by case at the discretion of Northcity Solutions, LLC.

Limitation of liability

Northcity Solutions, LLC provides technical services and is not responsible for business outcomes. Liability is limited to the amount paid for services in the preceding 30 days.

Termination

Either party may end the engagement at any time with reasonable notice. On termination you get your data, and any outstanding obligations are settled according to the terms of the individual agreement.

Governing law

These terms are governed by the laws of the State of Idaho.

SMS accountability coaching

The following applies only if you have separately enrolled in Northcity's SMS accountability coaching service. It does not apply to web, hosting, or email work.

By providing your phone number and enrolling, you expressly consent to receive automated SMS messages from Northcity Solutions, LLC. You may withdraw consent at any time by replying STOP or by contacting us directly.

Participants may enter into a voluntary financial accountability agreement with their coach. Terms of any such agreement are established between the participant and coach prior to enrollment. Northcity Solutions, LLC facilitates payment processing for agreed-upon accountability stakes via Stripe. By saving a payment method, you authorize charges in accordance with your accountability agreement. All charges are disclosed in advance and agreed to by the participant.

Northcity Solutions, LLC provides accountability tools and is not responsible for individual outcomes.
